Property Fraud Guide for Homeowners

What Is Property Fraud?

Property fraud occurs when someone records a document affecting ownership of your property without your knowledge or consent. For example, a fraudster may use a forged signature to illegally transfer ownership of your property.

If you have been notified that a document has been recorded against your property, take the following steps immediately.

What to Do If You Suspect Property Fraud:

  1. Contact Your Local Police Department
    Property fraud is a criminal matter. Contact your local police department to initiate a police report.
    Be prepared to provide:
    • Copies of the suspicious documents
    • Proof of your identity
    • Evidence of your ownership of the property
    • Any correspondence related to the fraudulent activity
  2. Contact the New York State Attorney General’s Office Homeowner Protection Program (HOPP)
    The Office of the New York State Attorney General supports a network of nearly 90 legal services and housing counseling organizations that provide free assistance to homeowners across New York State.

  3. Contact the Westchester County Clerk’s Office Land Records Division
    Obtain certified copies of fraudulent records filed in the County Clerk’s Land Records Division.

  4. Sign Up for the Westchester County Clerk’s Property Alert Service System (WCCPAS)
    How the Property Alert System Works
    Property Registration: Property owners voluntarily register properties they wish to monitor by owner’s name or by address through a secure platform.
    Email Notification: Registered users receive timely email notifications with details of documents recorded matching the name or address registered in WCCPAS to review and take action.
